2. Hosting (Shopify)

Our online shop is hosted by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. When you visit the website, server log files (including IP address, date and time, and browser type) are processed automatically. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in the technical provision and security of the website). We have concluded a data processing agreement with Shopify (Art. 28 GDPR). Data may be transferred to group locations in Canada and the USA; such transfers are based on the adequacy decision for Canada and the EU-U.S. Data Privacy Framework, respectively.

3. SSL/TLS Encryption

For security reasons, this site uses SSL/TLS encryption. You can recognize an encrypted connection by the "https://" in the address bar.

4. Waitlist and Email Marketing

If you sign up for our waitlist via our form, we process your email address and, if provided, your name and country in order to inform you about product releases. The legal basis is your consent (Art. 6(1)(a) GDPR). Registration uses a double opt-in procedure. You can withdraw your consent at any time with effect for the future, e.g. via the unsubscribe link in every email.

5. Order Processing

To process your order, we process the data you provide at checkout (name, address, email address, payment details). The legal basis is Art. 6(1)(b) GDPR (performance of a contract). We pass on your address to the commissioned shipping company for the purpose of delivery. For deliveries outside the European Union, we are additionally required to transmit your name, address and details of the goods to the customs authorities of the country of destination and to German export customs. The legal basis is Art. 6(1)(c) GDPR (compliance with a legal obligation).

6. Payment Service Providers

Shopify Payments: If you pay by credit or debit card, payment is processed via Shopify Payments. The legal basis is Art. 6(1)(b) GDPR.

PayPal: If you pay via PayPal, your payment details are transmitted to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The legal basis is Art. 6(1)(b) GDPR.

7. Meta Pixel

This website uses the Meta Pixel of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland — exclusively after your consent via the cookie banner. It allows us to measure the effectiveness of our advertising. The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). Data may be transferred to Meta servers in the USA; such transfers are based on the EU-U.S. Data Privacy Framework. You can withdraw your consent at any time via the cookie settings.

8. Cookies

We use technically necessary cookies (e.g. for the shopping cart and login) on the basis of § 25(2) TDDDG and Art. 6(1)(f) GDPR. All other cookies (e.g. marketing) are only set after your consent via the cookie banner (Art. 6(1)(a) GDPR, § 25(1) TDDDG).

9. Storage Periods

We retain order and invoice data within the statutory commercial and tax retention periods (6 or 10 years, §§ 257 HGB, 147 AO). Waitlist data is stored until you withdraw your consent.

10. Your Rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and the right to object to processing based on legitimate interests (Art. 21 GDPR). You may withdraw any consent you have given at any time with effect for the future. You also have the right to lodge a complaint with a data protection supervisory authority; the competent authority is the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (Landesbeauftragter für den Datenschutz und die Informationsfreiheit Baden-Württemberg).

General Terms & Conditions (AGB)

§ 1 Scope

(1) These General Terms and Conditions apply to all orders placed through the online shop www.sidera-jewelry.de by consumers and entrepreneurs.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB, German Civil Code).

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking the "Buy" / "Buy now" button in the final step of the ordering process, you place a binding order for the goods contained in your shopping cart.

(3) The purchase contract is concluded when we accept your order by sending an order confirmation email immediately after receiving your order.

§ 4 Prices, Taxes and Shipping Costs

(1) All prices stated are final prices in euros.

(2) For deliveries within Germany, prices include the statutory German VAT of currently 19%.

(3) For deliveries to the United States, the sale is a tax-exempt export delivery pursuant to Sec. 4 No. 1a in conjunction with Sec. 6 of the German VAT Act (UStG). No German VAT is charged and none is shown on the invoice.

(4) We deliver to the United States on a Delivered Duty Paid basis. United States import duty and customs handling charges are paid by us and are already included in the price shown. You will not be asked to pay anything to the carrier on delivery.

(5) Any additional shipping costs are displayed during the ordering process before you place your order.

§ 5 Payment

Payment is made by credit card, debit card, or other payment methods offered at checkout (Shopify Payments), as well as by PayPal. If you choose PayPal, payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., subject to its terms of use.

§ 6 Delivery

(1) We deliver within Germany and to the United States.

(2) Within Germany, the delivery time is 2 to 4 business days after receipt of payment, unless otherwise stated for the item.

(3) To the United States, delivery takes up to 14 business days after receipt of payment, including customs clearance.

(4) All shipments are tracked and insured, and shipping is free of charge on every order.

(5) Orders containing more than one piece may be sent in separate parcels arriving on different days, for customs reasons. This does not affect your rights under these terms.

§ 7 Retention of Title

The goods remain our property until payment has been made in full.

§ 8 Right of Withdrawal and Returns

Consumers resident in the European Union are entitled to the statutory right of withdrawal. For orders delivered to the United States, a voluntary 30 day return policy applies instead. Details of both can be found in the Withdrawal and Returns Policy.

§ 9 Warranty and Nature of the Goods

(1) The statutory warranty law applies.

(2) The jewelry pieces offered are unique items made from natural material. Each meteorite slice is one of a kind; deviations in color, structure, grain, and shape from product images are inherent to the natural material and do not constitute a defect. The stone weight stated on the product page is the decisive selection criterion.

§ 10 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory consumer protection provisions of the country of their habitual residence.

Right of Withdrawal

Withdrawal Policy

This withdrawal policy applies to customers resident in the European Union. If your order is delivered to the United States, please see the separate section further down this page.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take(s) possession of the goods.

of your decision to withdraw from this contract by means of an unambiguous declaration (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period expires.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Returns for Deliveries to the United States

The statutory right of withdrawal set out above applies to customers in the European Union. For orders delivered to the United States, the following voluntary return policy applies instead.

You may return any piece within 30 days of delivery, for any reason.

How to return a piece. Write to leo.koch@sidera-jewelry.de before sending anything back. We will confirm your return in writing and give you the return address. Returns sent without prior confirmation cannot be processed.

Condition. The piece must be unworn and in its original condition, and must be returned complete with its certificate of authenticity, its chain and its original packaging. We may reduce your refund to reflect any loss in value caused by handling beyond what is necessary to establish the nature and characteristics of the piece.

Return shipping. You arrange and pay for the return shipment. Please use a tracked and insured service. Until the piece reaches us, it remains at your risk, so please keep your proof of postage and your tracking number.

What we refund. We refund the price of the piece in full, within 14 days of receiving it, using the payment method you used for the order.

We do not refund the United States import duty and customs handling charges. We pay these to United States Customs on your behalf when the parcel enters the country, and they are not returned to us when a piece is re-exported. Outbound shipping is free of charge on every order, so there is nothing to refund there.

Faulty or damaged pieces. If a piece arrives damaged or is not as described, this policy does not apply. Write to us within 14 days of delivery and we will arrange and pay for the return, and refund you in full including all duties and charges.
